1. Introduction and acceptance

These Terms & Conditions ("Terms") govern your access to and use of the website located at www.coachhunter.com.au and any related services (the "Platform"), operated by Coach Hunting (ABN 26 596 713 269) ("CoachHunter", "we", "us" or "our").

By accessing, registering for, or using the Platform, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Platform.

We may update these Terms from time to time (see Section 18). Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

2. About the Platform

CoachHunter is an online marketplace that allows sports coaches to create and promote profiles, and allows students to search, filter, enquire with, and review those coaches.

CoachHunter is a marketplace and directory only. We do not provide coaching, training, or any related services, and we are not a party to any arrangement, agreement, or transaction between a coach and a student (or club). Any coaching services are provided directly by the relevant coach. We do not employ, engage, endorse, guarantee, supervise, or take responsibility for any coach, student, or the services they provide or receive. Any dealings between users are solely between those users, at their own risk.

3. Eligibility

To register as a coach, you must be at least 18 years of age and legally able to provide the services you list.

There is no minimum age for students. However, if you are under 18, you may only register and use the Platform with the consent and supervision of a parent or guardian, who agrees to these Terms on your behalf and is responsible for your use of the Platform.

By registering, you confirm that the information you provide is true, accurate and complete, and that you meet the applicable eligibility requirements.

4. Accounts

4.1 Account types. The Platform supports different account types, which may include Coach accounts, Student accounts, and (in future) Club accounts. Administrator accounts are operated by CoachHunter to manage the Platform.

4.2 Registration. You must provide accurate and complete information when creating an account and keep it up to date.

4.3 Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised use of your account. You must not share your account or allow others to use it.

4.4 One account. You must not create multiple accounts to circumvent restrictions or impersonate others.

5. Coach obligations and responsibility for content

If you register as a coach, you are solely responsible for the content you submit, and you agree that:

All information in your profile — including your name, gender, qualifications, certifications, training, experience, pricing, images, availability and external links — is true, accurate, current, and not misleading.

You hold, and will maintain, all qualifications, registrations, licences and insurance necessary to lawfully provide your services.

Where your services involve working with children, you hold a valid Working with Children Check (or equivalent required by law in your jurisdiction) and comply with all applicable child-safety laws. You acknowledge that CoachHunter does not verify these matters on your behalf.

You have the right to use and upload all content and images you submit, and that they do not infringe any third party’s rights.

You will honour the pricing and services you represent on your profile, and deal with students honestly and professionally.

You acknowledge that CoachHunter does not independently verify coach profiles, qualifications, or credentials unless expressly stated, and that responsibility for the accuracy of that content rests with you.

6. Student obligations

If you use the Platform as a student, you agree to:

Provide accurate information in your account and enquiries.

Use the Platform and communicate with coaches lawfully and respectfully.

Make your own enquiries and satisfy yourself as to a coach’s suitability, qualifications, and safety before engaging them. CoachHunter does not guarantee any coach.

Where you are a parent or guardian registering or acting on behalf of a minor, take responsibility for that minor’s use of the Platform.

7. Enquiries and communications

The Platform enables students to send enquiries to coaches. You are responsible for the content of your communications. Enquiries and communications must not contain unlawful, misleading, offensive, or harassing content. CoachHunter is not responsible for the accuracy, content, or outcome of communications or arrangements made between users, and does not guarantee that any enquiry will receive a response.

8. Reviews and user-generated content

8.1 Reviews. Registered students may submit reviews about coaches, and coaches may reply to reviews about them. Reviews must be genuine, based on real experience, honest, and not misleading.

8.2 Content standards. All user-generated content — including profiles, reviews, replies, enquiries and images — must not:

Be false, misleading, defamatory, or fraudulent

Be offensive, abusive, harassing, threatening, discriminatory, or obscene

Infringe any intellectual property, privacy, or other rights

Contain unlawful content or promote unlawful activity

Contain spam, advertising unrelated to the Platform, malware, or harmful code

8.3 Moderation and approval. We may review, moderate, approve, edit, refuse to publish, or remove any user-generated content at our discretion, including reviews that we reasonably believe breach these Terms. We are not obligated to monitor content but may do so. Approval or publication of content does not constitute our endorsement of it.

8.4 Licence to display. By submitting content to the Platform, you grant CoachHunter a non-exclusive, royalty-free, worldwide licence to host, use, reproduce, display and distribute that content for the purpose of operating and promoting the Platform. You retain ownership of your content.

9. External links

Profiles and other content may contain links to external websites operated by third parties. These links are provided for convenience only. We do not control, endorse, or accept responsibility for the content, products, services, or privacy practices of any external website. Accessing external links is at your own risk.

10. Paid promotional features

Coaches may purchase promotional features, such as priority placement within a sport category or featured display on the home page.

Fees, inclusions and the duration of any promotional feature will be described at the point of purchase.

Payments are processed by our third-party payment provider ([PAYMENT PROCESSOR — e.g. Stripe]). By purchasing, you agree to that provider’s terms.

Purchasing a promotional feature affects placement and visibility only. It does not constitute any endorsement by CoachHunter, nor any guarantee of enquiries, students, or results.

Except as required by law (including the Australian Consumer Law), fees are non-refundable.

Note: As the Platform expands (e.g. club subscriptions, an equipment marketplace, forums, and commission or management fees), additional terms specific to those services should be added here or in supplementary terms.

11. Prohibited activities

You must not:

Provide false, inaccurate, or misleading information

Impersonate any person or entity, or misrepresent your affiliation

Harass, abuse, threaten, or harm any other user

Post or transmit unlawful, defamatory, obscene, or infringing content

Use the Platform for any fraudulent or unlawful purpose

Circumvent, disable, or interfere with the security or operation of the Platform

Scrape, harvest, or collect data from the Platform without our written consent

Attempt to gain unauthorised access to any part of the Platform or another user’s account

Use the Platform to send spam or unsolicited communications

Do anything that damages, disables, or impairs the Platform

12. Intellectual property

The Platform, including its design, text, graphics, logos, and software (excluding user-generated content), is owned by or licensed to CoachHunter and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from the Platform without our prior written consent.

13. Content removal and account suspension

We may, at our discretion and where reasonable, remove content, and suspend or terminate any account, with or without notice, where we reasonably believe a user has:

Breached these Terms

Provided false or misleading information

Engaged in prohibited or unlawful activity

Created a risk or possible legal exposure for CoachHunter or other users

You may close your account at any time by contacting us. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, and indemnity) will survive.

14. Disclaimers

To the maximum extent permitted by law:

The Platform is provided on an “as is” and “as available” basis, and we do not warrant that it will be uninterrupted, error-free, or secure.

We do not vet, verify, endorse, or guarantee any coach, student, club, their identity, qualifications, credentials, conduct, or the quality, safety or legality of any services offered or provided through the Platform (unless expressly stated).

We are not responsible for the acts, omissions, or conduct of any user, or for any dealings, arrangements, or disputes between users.

You engage with, and rely on, other users at your own risk and are responsible for making your own enquiries and safety checks.

15. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other law that cannot lawfully be excluded.

To the maximum extent permitted by law, and subject to the paragraph above:

CoachHunter is not liable for any indirect, incidental, special, or consequential loss, or loss of profits, revenue, data, or opportunity, arising from or in connection with your use of the Platform or any dealings between users.

Where our liability cannot be excluded but can be limited, our total liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied; and in any event our aggregate liability to you will not exceed the total amount (if any) you paid to us in the 12 months before the relevant claim.

16. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless CoachHunter and its officers, employees and agents from any claims, losses, liabilities, damages, costs and expenses arising out of or in connection with your use of the Platform, your content, your breach of these Terms, or your breach of any law or the rights of any third party.

17. Complaints and dispute resolution

17.1 Disputes with us. If you have a complaint about the Platform or these Terms, please contact us at contact@coachhunter.com.au. We will acknowledge your complaint and work with you in good faith to resolve it within a reasonable time.

17.2 Disputes between users. Disputes between coaches and students (or clubs) are the responsibility of the users involved. While we are not obliged to become involved, we may, at our discretion, provide reasonable assistance. We are not liable for the outcome of any dispute between users.

17.3 Good faith. Before commencing any legal proceedings (except for urgent injunctive relief), the parties agree to attempt to resolve the dispute in good faith.

18. Changes to these Terms

We may amend these Terms from time to time. The current version will be available on the Platform, and the “Last updated” date will reflect the latest changes. Where changes are material, we will take reasonable steps to notify you. Your continued use of the Platform after changes take effect constitutes acceptance.

19. Governing law

These Terms are governed by the laws of the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.

20. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.

Our failure to enforce any provision is not a waiver of that provision.

You may not transfer your rights under these Terms without our consent. We may assign our rights and obligations, for example in connection with a sale or restructure of our business.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CoachHunter regarding the Platform.
